TERMS OF SERVICE – HOBBIIST PHOTOGRAPHY SERVICES (EU FRAMEWORK)

Location: [Sweden, EU]1. DEFINITIONS
"Client" means the individual or entity engaging the Photography Service.
"Photographer" means the service provider operating under these Terms.
"Deliverables" means the photographs, digital files, prints, or other materials produced.
"Personal Data" means any information relating to an identified or identifiable person under GDPR.
2. SCOPE OF SERVICE
These Terms govern the relationship between the Photographer and Client regarding photographic services, including but not limited to: portrait sessions, event coverage, commercial shoots, and related deliverables.
Services provided are hobbyist in nature and do not constitute professional commercial guarantees unless explicitly stated otherwise in a written agreement.
3. BOOKING AND PAYMENT TERMS
3.1 A booking requires:
Written confirmation via email or digital platform
A non-refundable deposit of [X]% of total fees
Payment of remaining balance before delivery of final deliverables
3.2 Payment methods accepted: bank transfer, SEPA, or other mutually agreed methods.
3.3 Late payments incur interest at the statutory rate applicable in the Photographer's country (e.g., § 288 BGB in Germany, or local equivalent).
3.4 All amounts quoted are exclusive of VAT where applicable. Client agrees to pay any applicable VAT.
4. CANCELLATION AND RESCHEDULING
4.1 Client-initiated cancellation:
More than 14 days prior: deposit retained, no further charges
Less than 14 days prior: [X]% of total fee charged
Day-of cancellation: full fee payable
4.2 Photographer-initiated cancellation:
Photographer will refund all amounts paid.
No additional liability beyond refund applies
4.3 Rescheduling is permitted once without penalty if requested more than 7 days in advance.
Note: Under EU Consumer Rights Directive (Directive 2011/83/EU), cancellation terms must be fair. Overly punitive late-cancellation fees may be deemed unfair.
5. INTELLECTUAL PROPERTY
5.1 The Photographer retains all copyright and intellectual property rights in all images created under these Terms, unless explicitly transferred in writing.
5.2 Client receives a non-exclusive, non-transferable license to use Deliverables for:
Personal, non-commercial purposes only
Social media sharing (with attribution where requested)
Printing for private use
5.3 Client may not:
Sell, license, or commercially exploit the images
Submit to stock agencies or competitions without consent
Alter, modify, or create derivative works without permission
Use images for endorsement, advertising, or commercial promotion
5.4 Third-party releases (where model release or property permissions are needed) are Client's responsibility unless explicitly arranged by Photographer at Client's expense.
6. IMAGE DELIVERY AND ACCEPTANCE
6.1 Delivery Timeline: Images will be delivered within [X] business days of session completion, unless delayed by circumstances beyond Photographer's control.
6.2 Format: High-resolution JPEGs or as otherwise agreed.
6.3 Client has [X] days to notify Photographer of technical defects in Deliverables after receipt.
6.4 Failure to notify within this period constitutes acceptance of Deliverables.
7. LIMITED WARRANTY AND DISCLAIMERS
7.1 Photographer warrants Deliverables will be free from gross technical defects attributable to negligence.
7.2 NO OTHER WARRANTIES are provided, express or implied, including merchantability or fitness for particular purpose.
7.3 Photographer is not liable for:
Incidental or consequential damages
Loss of sentimental value of images
Failure to capture specific moments due to circumstances beyond control
Equipment malfunction, weather interference, or force majeure
7.4 Liability Cap: Total liability shall not exceed the amount paid by Client for the specific service giving rise to the claim.
Note: Under EU Unfair Contract Terms Directive (93/13/EEC), exclusions of liability for gross negligence, death, injury, or fundamental breach may be void.
8. DATA PROTECTION (GDPR COMPLIANCE)
8.1 Personal Data collected includes: name, contact information, billing details, and potentially images containing individuals.
8.2 Legal Basis for Processing:
Contractual necessity (performance of service)
Legitimate interests (portfolio use, with opt-out option)
8.3 Rights Granted: Access, rectification, erasure, restriction, portability, objection.
8.4 Data Retention:

9. CONDUCT AND SAFETY
9.1 Client agrees to ensure safe conditions during the shoot, including property access and participant safety.
9.2 Photographer reserves the right to terminate the session without refund if Client, participants, or third parties:
Create unsafe conditions
Harass or intimidate the Photographer
Violate property laws or regulations
Are intoxicated or under influence affecting behavior
9.3 Photographer maintains insurance covering equipment and public liability, but Client acknowledges inherent risks in outdoor/location photography.
10. FORCE MAJEURE
Photographer is not liable for failure or delay caused by:
Natural disasters
Pandemics or health emergencies
Government restrictions
Equipment failure not due to negligence
Other circumstances beyond reasonable control
In such cases, Photographer will propose rescheduling or refund prepaid amounts minus expenses already incurred.
11. NON-SOLICITATION AND REFERRALS
11.1 Client agrees not to hire or solicit any subcontractor or associate of Photographer discovered during engagement without Photographer's consent.
11.2 Referral credits or discounts apply at Photographer's discretion.
12. PORTFOLIO USE AND PUBLICITY
12.1 Unless Client opts out in writing, Photographer may use Deliverables for:
Portfolio display (website, social media)
Marketing materials
Competitions and publications
12.2 Client may request removal of images from portfolio at any time; Photographer will comply within reasonable timeframe.
12.3 Where subjects other than Client appear, separate consent may be required.
13. GOVERNING LAW AND JURISDICTION
13.1 These Terms are governed by the laws of [Country], without regard to conflict of law principles.
13.2 For Business-to-Consumer transactions:
Exclusive jurisdiction lies with courts of Consumer's habitual residence (Regulation (EU) No 1215/2012)
Mandatory consumer protection laws prevail over contractual terms
13.3 Alternative Dispute Resolution: Consumer disputes may be submitted to the European Online Dispute Platform (https://ec.europa.eu/odr) or local consumer arbitration body.
14. ENTIRE AGREEMENT AND AMENDMENTS
14.1 These Terms constitute the entire agreement between parties regarding the subject matter.
14.2 Modifications require written agreement or acknowledgment via digital acceptance mechanism.
14.3 Continued use of services after amendments constitutes acceptance.
15. SEVERABILITY
If any provision is held invalid or unenforceable under applicable law, the remaining provisions continue in full force. Invalid provisions shall be replaced with terms closest to original intent.
16. ACKNOWLEDGMENT
By booking, paying, or otherwise accepting services, Client acknowledges having read, understood, and agreed to these Terms.

1. Permission to Use Likeness
I, the Model named above, grant the Photographer/Creator and their assigns, licensees, and representatives the irrevocable right to use, reproduce, publish, distribute, and display photographs, video, audio recordings, and/or digital images in which my likeness, voice, or identifiable features appear (collectively, the "Works").
2. Scope of Use
The Photographer/Creator may use the Works for any or all of the following purposes:

I release the Photographer/Creator and their successors from any claims relating to the use of the Works, including but not limited to claims for invasion of privacy, defamation, infliction of emotional distress, or violation of right of publicity, except where the Works are used in a manner that constitutes defamation or intentional misrepresentation of my character.
7. Minor Model (if applicable)
If the Model is under 18 years of age, the parent or legal guardian must sign below and confirms they have the authority to grant this release.
